Why you need an agent before you visit a model home

The single most expensive mistake new-construction buyers make in Davis County is walking into a model home without their own agent registered. This article explains why, and how to protect yourself.

The on-site agent does not work for you

Every builder model home in Davis County has a sales rep on site. That rep is friendly, knows the floor plans cold, and answers every question. They are also legally and contractually an agent of the builder — not you.

Their job is to sell the builder's inventory at the builder's terms. The contract they hand you is the builder's contract. The upgrades they offer are priced at the builder's margin. The construction timeline they quote favors the builder's scheduling. None of that is dishonest — they are doing their job. But nobody in the room is doing your job: reading the contract on your side, negotiating builder upgrades on your behalf, watching for what should be in writing, and pushing back on terms that are not in your interest.

The first-contact rule

Builders pay the buyer's agent commission. That is good news for buyers — having your own agent costs you nothing on a new-construction purchase. But there is a catch: the builder will only pay that commission to an agent who was registered BEFORE the buyer's first contact with the model home, the builder's sales rep, or the builder's online lead form.

If you walk in unrepresented, the builder's on-site agent registers you as their own buyer. From that moment, you cannot add an outside agent to the transaction. The commission stays with the builder's rep. You can still bring in a real estate attorney to review documents, but you cannot add a buyer's agent who works for you. This is the "procuring cause" rule, and every major Davis County builder enforces it.

What registration actually means

Registration is a simple administrative step. Your agent calls or emails the builder's sales rep BEFORE you visit and says: "I represent [your name and contact info]. They are considering [development]. I am registering them with you per the standard procuring-cause rules." The rep logs it. From that moment your agent is your representation on this builder's inventory.

Registration is per-builder and usually per-development. If you are evaluating three builders, your agent registers you with all three. If you walk into a fourth builder unrepresented, that fourth one is on you — but the other three stay covered.

What you get when you register first
